National Night Out 2018

A question was posted on Facebook asking if the HOA was planning anything for National Night Out this year. At this time, the Board of Directors has not discussed doing anything for National Night Out.

We do encourage everyone though, if they wish to participate, to coordinate something between yourselves. As a community, we don't need the HOA to sponsor anything to get together.

If you and your neighbors decide to have a small gathering or party, use the Website Request page to a send a message and we will post it here in case others want to stop by and say hello.

Also remember that you can let the City of Kyle know about your gathering. You can complete the form found on their site here: https://www.cityofkyle.com/police/national-night-out-2018. The City of Kyle is also hosting a party downtown at City Square Park that you can attend. Information for the party downtown is on the same website link posted above.

Indian Paintbrush Community Garage Sale

The Indian Paintbrush HOA is organizing a Community Garage Sale on October 13th and 14th.

We would like as many households to participate in the Community Garage Sale as possible.

Advertisement of the Community Garage Sale will be posted on various websites including Next Door, Craig’s List and others with the addresses of those choosing to participate around the beginning of October and again the weekend before.

Signs are the responsibility of the participants to create and post beforehand and remove afterwards.

We hope you benefit from having a Community Garage Sale and enjoy seeing what treasures your neighbors are selling that you simply can't live without! Who knows, you may find that fascinating collectible item that you are missing from your collection, a great gag gift for your next office party, accessories for your Halloween costume or just simply a good deal on something you need or want.

Water Conservation Notice – Stage 2

Monarch Utilities notified us with the last billing statements that we are in Stage 2 water restrictions. Per the Monarch Utilities notice:

Goal:
Achieve a twenty percent (20%) MANDATORY reduction in total and daily water demand.

Triggers/Reasons:
When any of the following occur:
  • When the water treatment capacity reached for three (3) or more days in a week is equal to or greater than seventy-five percent (75%).
  • When well pump hours per day for more than three (3) days is equal to or greater than 18 hours.
  • When the TCEQ, a governing groundwater district, or a contracted water supplier requests initiation of a twenty percent (20%) usage reduction.

Mandatory Restrictions:
  • Use of automatic irrigation systems and hose end sprinklers is limited between 12:01am to 4:00am and 8:00pm to 11:00pm on the designated watering days. Once weekly watering is allowed.
  • Use of soaker hoses on landscaped areas is allowed from 12:01am to 10:00am or from 8:00pm to 11:59pm on designated watering days.
  • Use of a hand-held hose (unattended hoses are prohibited), a faucet-filled bucket or watering can of five (5) gallons or less, or drip irrigation systems is permitted on the designated watering day from 12:01am to 4:00am or from 7:00pm to 11:59pm.
  • Washing vehicles, motorbikes, boats, trailers, airplanes or other vehicles is prohibited. Vehicle washing may be done at any time on the immediate premises of a commercial car wash or commercial service station. Further, such washing may be exempted from these regulations if the health, safety, and welfare the public are contingent upon frequent vehicle cleansing, such as garbage trucks and vehicles used to transport food and perishables.
  • Topping of pools is allowed on the approved Watering Day Schedule.
  • Washing or rinsing driveways, sideways, or streets is prohibited at all times. The use of water for construction purposes from designated fire hydrants is permitted under special permit.

    Address ends in 5 - Friday

Violations & Penalties:

First Violation: The customer will be notified by written notice of their specific violation.

Second Violation: After written notice, the utility may install a flow restricting device in the line to limit the amount of water which will pass through the meter in a 24-hour period. The utility may charge the customer for the actual cost of installing and removing the flow restricting device, not to exceed $50.00.

Third Violation: The utility may discontinue service at the meter for a period of seven (7) days, or until the end of the calendar month, whichever period is shorter. The normal reconnect fee of the utility will apply for restoration of service.

How To Help Victims of San Marcos Apartment Complex Fire

By now, most if not all of us should have heard about the San Marcos Iconic Village and Vintage Pad Apartments fire that destroyed over 100 apartments and killed 5 people. Maintenance of Sidewalks Required by the City of Kyle

This is just a reminder that if your lot has one or more attached sidewalks, the City of Kyle expects the sidewalks to be kept in good working condition. Good working condition means free from weeds, brush, earth, garbage/trash, junk, rubbish or solid waste (see descriptions below) as well as being structurally intact and safe to walk on.

Here is city ordinance information pulled from the City of Kyle website:
    Sec. 23-86. - Definitions.

    The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Brush means all uncultivated shrubs, bushes and small trees.

    Earth and construction materials means earth, rocks, bricks, concrete, other similar materials and waste materials resulting from construction or remodeling.

    Garbage means rubbish, trash, kitchen and household waste, ashes, bottles, cans, rags, paper, food containers, lawn trimmings, tree trimmings, hedge trimmings, leaves, grass, weeds and refuse, and all decayable wastes, including animal and vegetable matter, but not including sewage, hazardous, toxic or corrosive materials, and earth and construction materials as herein, or any other material which may be found to be harmful to garbage collection and handling personnel or equipment.

    Injure means any and all character of physical damage, whether caused by fire or force, and which shall be done or caused willfully by any person.

    Junk means all worn out, worthless and discarded material, in general, including, but not limited to, odds and ends, old iron or other metal, glass, paper, cordage or other waste or discarded materials.

    Lot means, in addition to land within the boundaries of the property lines, all land adjacent to and extending beyond the property lines of any lot or parcel of land to the curblines or adjacent streets where curblines have been established or, where no curblines have been established, to eight feet beyond the property lines.

    Refuse. See Garbage.

    Rubbish means all refuse, old vessels of all sorts, useless articles, abandoned pipe, discarded clothing and textiles of all sorts, and in general all litter. The term "any and all objectionable or unsanitary matters," is not included within the meaning of the other terms as herein used, means those which are liable to produce or tend to produce an unhealthy, unwholesome or unsanitary condition to general locality where the same are situated.

    Solid waste means household garbage and refuse and commercial garbage and refuse, brush cutting and weeds.

    Trash. See Garbage.

    Unwholesome matter means all stagnant water, filth, carrion, impure matters and any condition liable to produce disease.

    Weeds means all rank and uncultivated vegetable growth or matter which is liable to become an unwholesome or decaying mass or breeding place for flies, mosquitoes or vermin.

    Sec. 38-21. - Maintenance of sidewalks on lots required.

    (a) All persons owning lots in this city upon the streets shall keep the sidewalks around the same in good condition. In failing to do so he shall be fined in any sum not less than $5.00 nor more than $100.00.

    (b) The city, at its sole discretion, may elect to facilitate the repair of any sidewalk within the city limits or authorized by agreement. The election of the city to facilitate such a repair does not remove the requirement upon the property owner to properly maintain sidewalks and in no way absolves the property owner from liability.

If the sidewalks attached to your property have structural integrity issues, please reach out to the City of Kyle to first see if they would be willing to make repairs and be prepared to provide examples why. We recommend first starting with Code Enforcement and you will likely be referred to Public Works. Code Enforcement may refer you to Public Works since they, Public Works, will likely be performing the repairs should the City of Kyle assume ownership of the repairs.

If they will not make repairs for some reason, then ask if they have information or guidelines that must be followed should you want to make the repairs yourself. At this point, the discussion of who repairs what is between you and the City of Kyle to negotiate and come to resolution on.

With regards to grass/weeds that grow between sidewalk slabs, the ramps present at intersections and the grassy area between the sidewalk and the street curb, owners, occupants, lessee or renters are responsible for maintaining any growth as if it were part of your yard, lot or property.

Here is city ordinance information pulled from the City of Kyle website:

    Sec. 23-116. - Prohibited conduct.

    It shall be unlawful for an owner, occupant, lessee or renter of any lot or parcel of ground within the city to fail to keep the property free from brush, earth and construction materials, garbage, junk, refuse, rubbish, solid waste, trash, weeds, unwholesome matters and any other objectionable, unsightly, or unsanitary matter of whatsoever nature, or to fail to keep the sidewalks in front of property free and clear of weeds and tall grass from the line of such property to the established curbline next adjacent thereto, or to fail to fill up and drain holes and depressions in which water collects, or to regrade any lots, grounds or yards or any other property owned or controlled by the owner, occupant, lessee, or renter which shall be unwholesome or have stagnant water thereon, or which from any other cause, is in such condition as to be liable to produce disease or to fail to keep any house, building, establishment, lot, yard or ground owned or occupied or under his control at all times free from filth, impure or unwholesome matter of any kind.

    Sec. 23-122. - Limitation on height of grass and weeds.

    It shall be unlawful for any person who shall own or occupy any lots in the city to allow weeds and/or grass to grow on such lots to a height of more than 12 inches. Weeds and/or grass of a height exceeding 12 inches are declared a nuisance. Provided, however, this section shall not apply to property used for the growing of agricultural crops or grass if such property has not been plotted into lots.

New HOA Website

We have a new Indian Paintbrush HOA website for owners and residents. The new site is designed to provide more up to date information including a News Feed and a Calendar with local events.

There are also social media links to both the Facebook group and Nextdoor. Joining the Facebook group requires approval from the group owner and the group is not owned or managed by the HOA. It was setup and is managed by fellow homeowners. Nextdoor is like Facebook, but organized for neighborhoods and subdivisions and it's free to join.

Please take some time and review the new website and it's content. We have tried to consolidate as much information into one place as possible. If you feel something should be included or removed, please let us know. We will try to update it as often as possible.

Burn Ban Returns Friday, July 20 for Unincorporated Areas of Hays County

Hays County Courthouse, San Marcos, TX – The Hays County Commissioners Court on July 17 reinstated the burn ban beginning Friday, July 20 for unincorporated areas of Hays County. The Court set the date in order to give property owners a few days to complete needed burnings before extreme heat and lack of rain dry out the county, making outdoor burning unsafe.

During a burn ban, outdoor grills with lids can be used, but burn barrels (even those with lids) and other outdoor fires are prohibited. More information about burn bans and outdoor burning is available here.

County Fire Marshal Urges Caution with July 4th Fireworks, Outdoor Grilling
